The expected time frame for the regulations regarding expanded Estate Recovery for Medicaid has long since passed and no one (other than perhaps the NYS Governor’s office) has any idea what the expanded time frame is. The failure to have definite regulations in place that may or may not be satisfactory to all is a disservice to and is frustrating to both the Elder Law bar which needs to give creditable advice to clients and to governmental agencies which must abide by and/or enforce the law.
